Wrongful Death Suit Filed in Street Sweeper Accident
A wrongful death lawsuit has been filed on behalf of a man who was killed when a street sweeper fell on top of him. Wlsam.com has reported that Brian P. Miller was killed in 2009 when he got stuck in the compressor of one of the street sweeping trucks belonging to the Hunter Maintenance & Leasing Corporation.
Miller’s sister, Keri Goff, has filed a wrongful death suit claiming that Elgin Sweeping Services, the company that owned the vehicle, did not repair the vehicle properly and directly caused her brother’s death. The designer of the street sweeper vehicles is also named in the lawsuit. Goff is suing for $600,000 in damages in a 12-count lawsuit, according to the report.
Construction and maintenance vehicles, like any other vehicle, can be very dangerous to work with. Aside from this incident, there have been many other instances where a person working with some kind of construction equipment has suffered very serious injuries or has been killed. If the company that owned the vehicle in this incident is found to be responsible in any way for Miller’s death, Goff will be awarded the amount named in the lawsuit. However, there must be direct evidence demonstrating that the company knowingly failed to maintain or repair the vehicle if necessary.
