Bar Owner Charged in Wrongful Death Lawsuit for Overserving

The family of a 25-year-old man that was killed in Galveston, TX has filed a wrongful death lawsuit against R.D. Mainor Enterprises Inc, residents of Galveston Orvel Speck, Michael Drager and Robert Mainor arguing that Speck left a bar owned and operated by Drager and Mainor and was in an intoxicated state. The suit claims as a result of that intoxicated state, Speck slammed into Albert Meredith, his 3-year-old stepson and a second child.

According to the report, the staff at the bar served Speck drinks despite the fact that he had already been drinking prior to arriving at the bar. According to a previous report on the incident, Speck had no recollection of leaving the bar or being in the accident at all. Speck’s blood alcohol level was discovered to be three times the legal limit and the plaintiffs in the suit are looking to be compensated for damages related to pain and mental anguish.

In the state of Texas, it is illegal to serve alcohol to people that appear to be intoxicated to begin with. Therefore, the bar owners could be found at fault for this tragic accident since they served alcohol to Speck. Speck’s personal negligence in this matter would also put him at fault for the accident because he willingly put himself and others in a dangerous situation by operating a vehicle while intoxicated. The most unfortunate part of this incident is the fact that a 25-year-old man, his 3-year-old stepson and another child lost their lives as a result of another person’s reckless behavior.
