A 47-year-old man riding his bike was killed the night of the 10th after he was struck by a train. Police stated the bike rider bypassed the gates blocking the passage over the train tracks and did not hear the train coming because he was wearing headphones. The gates are reportedly equipped with flashing lights and loud bells, which should have prevented the bike rider from crossing the train tracks. A police lieutenant stressed the importance of obeying the signals on train tracks and other road constructions in order to prevent this type of accident from happening in the future.
Although this incident was labeled as an accident because of the man’s failure to obey the traffic signals and stop before the train crossed, there are many incidents when these types of accidents are found to be the fault of the train operator. In some cases, the train operator may unintentionally fail to stop the train before striking a pedestrian or other vehicle crossing the train tracks. Trains usually operate at very high rates of speed and it is often extremely difficult for the operator to stop the train before the accident occurs regardless of how much they try to stop it. In those cases, the train operator could still be held responsible for the accident. This train crash incident appears to be a tragic accident and the victim unfortunately lost his life, but it is very easy for an accident like this to occur due to negligence from the train operator.
A wrongful death lawsuit has been filed against a transit company after a man was killed when a Municipal bus struck him in April of last year. The lawsuit was filed on the man’s behalf by the man’s husband and accused the driver of negligence and carelessness in the bus accident. According to the lawsuit, the driver of the bus was distracted while she was un-wrapping a candy bar and accidently hit the accelerator instead of the brake when she saw the victim on the roadway. The accident caused the man to be pinned up a second bus, which caused his death. The report does not specify how much the man’s husband is seeking in the lawsuit.
Driver distraction is one of the leading causes of automobile accidents in the United States. There are many instances when a driver could easily be distracted and not see a person or another car on the road in front of them. Even if the vehicle is not traveling at a high rate of speed at the time of the accident, it is still possible for it to cause serious injuries in the event of an accident simply because of its weight. A bus weighs much more than a normal vehicle does so the possibility of serious injuries in an accident is dramatically increased. The most common forms of driver distraction is cell phone use or fumbling with the radio while driving. It is very easy for a driver to get distracted while on the road and cause a serious accident. In this incident, if the driver is found to have been distracted while she was operating the bus, she could be held accountable for causing the man’s death.
An employee working for a staging company in Wilkes-Barre, PA suffered an extremely serious leg injury that caused his leg to be severed from his body after a large pipe fell on him. The accident occurred the morning of the 26th when the employee was helping to move the pipe using some type of machinery when the pipe slipped and fell on him. Federal officials and officers with the Occupation Safety and Health Administration launched an investigation to determine the exact cause of the employee accident. The man suffered other injuries in the accident but city officials did not release any information pertaining to the extent of those injuries.
In any job requiring the use of heavy machinery, there is always an inherent risk for employees even if they are fully trained in using the machinery. As this incident demonstrates, machinery can easily fail and that failure could lead to serious injuries. Mechanical failure is one major cause of employee accidents leading to serious injuries. The proper function of the machinery that employees use cannot always be ensured and if the machinery is not properly maintained to make sure that it functions correctly, employees using the machinery could be placed in serious danger. The company in this incident could be held liable for the injuries that the victim suffered if the investigation from the OSHA and federal investigators reveals any safety hazards that the company failed to fix. Unfortunately, if any safety hazards are present and the company takes care of them, it will not reverse the tragic injuries this man suffered in the accident.
The company Raicam Clutch LTD, a British construction company was fined £5,000 (over $8,000 US) after one of its employees suffered injuries to his back and his neck after falling off a roof. The incident occurred in 2009 when the man tripped on a cable on the roof and fell 3.5 meters (11 ft) and suffered five broken vertebrae and whiplash on his neck. The company was fined because they failed to provide protection from falling for its employees.
The report states there was no netting or landing bags on the ground to prevent serious injuries. The company pleaded guilty to breaching the Work at Height Regulations developed in 2005. The injured employee could not return to work for four months following the accident. An inspector for the Health and Safety Executive argued that this incident could have been completely avoided if the company had taken steps to provide safety to its workers.
The inspector for the HSE argued that if the victim had been provided with some sort of protection from the fall, this incident would have been completely avoidable. This is one factor that some companies fail to take due to negligence or simple oversight. Regardless of the reason for the lack of protection, the companies that the victims work for should be held liable if there is significant proof that protection from the fall was possible. In this incident, the company could have provided padding on the ground in the event of a fall and the worker would not have been out of work for four months. As a result of this incident, the employee lost wages and suffered extremely serious injuries.
In West Valley City, UT, a 12-year-old boy suffered a broken pelvis, a broken arm and internal injuries after being struck by a vehicle as he was crossing a crosswalk to school. The boy is in serious condition in a medical facility as a result of this incident. A 36-year-old man driving his vehicle through the crosswalk struck the boy as he was crossing to get to school.
The man was reportedly taking his son to the same school at the time of the accident. He was cited for failure to yield to pedestrians at a crosswalk. Several witnesses including students at the school saw the accident occur and contacted authorities.
This incident demonstrates several things that people do not take into consideration when operating a vehicle or when crossing a street as a pedestrian. First, drivers must always yield to pedestrians attempting to cross a crosswalk because pedestrians have the right of way at the crosswalk when the “walk” sign has a green light. Secondly, this incident demonstrates how easily a person could be injured if a vehicle is coming too fast for them to stop. Sometimes people do not look in both directions before crossing a crosswalk and expect automobiles to stop for them. However, this is not always the case and some drivers do not always notice the crosswalk or simply fail to stop altogether. If the driver fails to stop and causes an accident leaving the victim with serious injuries or killing the victim, they should be held accountable for their actions in every case.
A sophomore student baseball player has returned home after a serious automobile accident caused a life-threatening brain injury last year. Rhett Nelson was reportedly driving north on Highway 221 in South Carolina when he lost control of his vehicle. Nelson’s vehicle flipped about four and a half times and landed in the southbound lane of the roadway. Nelson’s mother, Rosemary suffered several broken bones in the accident.
Nelson spent a total of 13 days in the hospital including 3 days on life support and seven in intensive care. Within two weeks, Nelson regained the ability to walk and the only lasting effect was short-term memory loss.
Nelson was extremely lucky to make a full recovery following an accident as serious as this one. Following a severe brain injury, many people are unable to regain certain functions and some don’t regain consciousness at all. There is no report on the factors that played a part in this accident. In many cases, accidents of this severity could be caused by several factors. Sometimes vehicles are known to have serious flaws that cause them to flip over as in this incident. Other times, the driver’s error could cause this type of accident. Statistics from the CDC state that roughly 1.7 people sustain brain injuries per year. About 275,000 of those people are hospitalized for various amounts of time and 52,000 die as a result of the injury. Brain injuries are a contributing factor in roughly 30% of all deaths linked to injuries, according to the CDC.
A worker at Disney’s Animal Kingdom Park at Walt Disney World in Orlando, Florida was killed after being struck by a rollercoaster cart. 52-year-old Russell Sherry Roscoe was working on part of the ride when he was struck by one of the ride’s vehicles and suffered massive head injuries as a result.
Co-workers rushed to provide first-aid care to Roscoe who was later transported to Orlando Regional Medical Center for medical care. Roscoe died the morning of the 14th as a result of his injuries. The accident occurred as the ride was closed for maintenance and the accident was not witnessed by any of the park’s visitors at the time.
Maintenance workers of any kind often find themselves in the line of danger, especially when they are in charge of fixing things like theme park rides that may malfunction at any time. The report stated this is the second death associated with the ride at Disney’s theme park. Theme parks have been known to be at the center of attention after patrons were killed as a result of one of the rides at the park.
There is always an inherent danger in any theme park ride and in most, if not all cases, there is an explicit warning prior to the patrons entering the ride. The report also states that Disney was fined $21,000 and after investigators discovered five safety violations in 2008. If this incident proves to be the fault of Disney or any of its workers, they could be held accountable for Roscoe’s death.
A Mount Pleasant, MI man was pronounced dead at the scene of a car-pedestrian accident that occurred at the intersection of High Street and Watson Road in Michigan. 51-year-old Joseph Feasby was struck by a Chevy truck as he was crossing through the intersection. The truck was being driven by a 16-year-old driver. The report states that neither drugs nor alcohol were involved in this incident.
Police have not determined whether or not excessive speed was a factor in this accident. At the time of the accident, roadways were slick due to winter conditions in Michigan. There is no information in the report if any charges or citations have been or will be filed in connection with this incident.
When driving in icy or otherwise slick road conditions, it becomes more difficult to keep a vehicle under control because the wheels of the vehicle tend to slip on the ice. If a driver is operating a vehicle at high speeds when the roads are slick, that demonstrates a lack of judgment as they could easily get into an automobile accident or a car-pedestrian accident, injuring a pedestrian like in this incident. If the driver in this incident is found to have been driving at high speeds, they should be held accountable for their actions. As a result of this incident, the victim’s family has to suffer the loss of their loved one as a result of an accident that could have possibly been averted.
Arizona marathon runner Sally Meyerhoff, who was considered to be one of the top 10 female runners in the country, died on Tuesday after her bicycle collided with a pickup truck in Maricopa. Meyerhoff won the P.F. Chang's Rock n Roll Arizona Marathon in January and was training for the 2012 Olympic Marathon Trials.
Meyerhoff, a Phoenix native and graduate of Mountain Pointe High School, was riding her bicycle through the intersection of White and Parker Road and the Maricopa-Casa Grande Highway, going south, when her bicycle collided with a truck that was heading east. Police have not said who was at fault in the accident, but a police spokeswoman said the driver did not show signs of impairment.
This tragic accident demonstrates the vulnerability of bicyclists, especially in automobile-heavy areas such as Phoenix. One out of every eight non-motorists killed in traffic accidents are bicyclists. Bicyclists are at a high risk for serious injury or death in accidents for two primary reasons: lower visibility and less protection. Their lower visibility makes them more vulnerable to inattentive or impaired drivers and they have very little protection between them and the pavement which typically makes the injuries they suffer much more severe.
In Long Beach, FL, a vehicle was ripped in half after a very serious collision with a second vehicle. The accident occurred on a roadway east of the San Gabriel River Freeway. According to a member of the Long Beach Fire Department, the front portion of the vehicle that was ripped in half stayed stationary but the other half landed in an embankment nearby.
The two occupants of the vehicle – a 27-year-old woman and a 9-year-old child – sustained minor to moderate injuries. The occupant of the second vehicle was taken to a medical facility suffering severe injuries. The victims’ identities have not been released at this time. An investigation is underway to determine the cause of the accident.
This incident demonstrates one end of the spectrum in terms of the severity of most automobile accidents. While some accidents may not be severe enough to cause serious injuries, accidents such as this one can be extremely serious. Fortunately, the two occupants in the vehicle that tore in half only suffered minor injuries and will recover. However, things could have been much worse as pain and suffering is often part of an accident.. Accidents like this can be caused by various things including driver error or the fault of another driver on the road. In this incident since there were two cars involved, it is possible that one of the drivers made some sort of error in judgment that caused the accident. If that is the case, they should be held responsible for causing the accident.
A fatal accident in Newport Beach, CA took the lives of three people and injured three others on January 15th. 27-year-old Julia Allen, 49-year-old Christopher De La Cruz, and 69-year-old Linda Burnett were all killed when the Ford Taurus Allen was driving slammed into the pickup truck De La Cruz and Burnett were riding.
The Ford Taurus was reportedly moving at a high rate of speed and even went airborne before hitting several other vehicles including a motorcycle. Three people were taken to a medical facility with injuries; one of them was reported in critical condition but was expected to survive their injuries sustained in the crash. Authorities are investigating the incident at this time.
This incident is yet another out of many that demonstrates the dangers of operating a vehicle at excessive speeds. When driving at high rates of speed, it is extremely difficult to react to any obstructions that may suddenly appear. Some accidents may not result in any injuries for those involved and only their vehicles may be damaged. However, as this incident demonstrates, speeding can cause very serious accidents resulting in one or more fatalities. If other causes are discovered in the investigation into this incident, the driver that is found at fault for this accident could face serious penalties.
In Sebewa, Township, Michigan, the passenger of a vehicle was killed in a two-car auto accident that occurred January 13th. 40-year-old Scott Schafer was riding in a vehicle driven by a 30-year-old woman when their vehicle crossed the center dividing line in a northbound road when a second vehicle traveling southbound struck the first vehicle on the passenger’s side. Schafer was pinned inside the vehicle and medical personnel pronounced him dead at the scene of the accident.
The driver of the second vehicle refused to be treated and the driver of the first vehicle was listed in serious condition as of the following Friday. There is no word on the factors that contributed to the accident and all vehicle occupants were wearing seatbelts and the vehicles’ airbags deployed as normal.
The report states that the roadways were slippery because of snowfall that had occurred in the area. Inclement weather can result in severe injury because it may cause roads to become slippery or icy. Icy or slick roads can easily cause a driver to lose control of their vehicle, as was the case in this incident. Although both drivers in this incident were not reported to be driving in an unsafe manner, there are many incidents when a driver may be driving at excessive speeds or driving erratically despite the poor road condition. This can dramatically increase the chances of being involved in a serious or even fatal auto accident. If one or more people are found to be at fault for the accident, they should be held responsible for their actions and the victims in such cases deserve some form of compensation for injuries or damages.
An off-duty police officer was killed in Cape Coral after being involved in a motorcycle accident. 24-year-old Scott Wheeler was riding his motorcycle on an eastbound road when another vehicle turned in front of him and Wheeler struck that vehicle. He was then ejected from the vehicle and died at the scene of the accident. According to an accompanying video in the CBS affiliated winknews.com, authorities believe speed may have played a part in this accident.
Speed appears to be a factor in a majority of motorcycle accidents that occur in general. It’s possible that people don’t always realize how fast they may be going until it is too late and they end up in a very serious accident. The major problem with motorcycles is the lack of protection they offer for the operator. It makes it very easy for a rider to be ejected from the bike because there is nothing securing them to the bike. For that reason, it is easy for a rider to suffer very serious injuries or lose their life. It is often difficult to determine who is at fault for an auto accident in general. However, if one person involved is believed to be driving at a high rate of speed and causes a fatality in the accident, they could be held liable for the accident. One of the most unfortunate things about this accident is that this off-duty police officer leaves behind a wife and 2 kids with a new baby on the way. Now that new baby will never get to know their father because of this incident.
In Colorado, a 35-year-old woman was killed when a wheel from a semi-truck fell off the vehicle and struck the roof of her car. The semi-truck was traveling southbound on I-25 in Colorado and the Toyota Camry the woman was driving was traveling northbound. The impact caused her vehicle to go off the road. The second wheel from the semi-truck came to a stop in a store parking lot. There is no report on what caused the wheels to come off the truck. An investigation has begun to determine the cause of the accident.
This incident demonstrates to possible causes for accidents such as this one. The first is simply unforeseen events that can lead to extremely serious or even fatal accidents. Things like poor road conditions or some other cause that is out of a driver’s control can easily lead to serious accidents. This accident is deemed a freak accident because the tires falling off of the truck could not possibly be foreseen. However, if the incident is linked to errors in manufacturing of the truck’s parts, the company responsible for manufacturing the truck’s parts could be held liable for not ensuring the safety of the truck prior to its use. Regardless of what the investigation uncovers, the victim’s family deserves some form of compensation for the loss they have suffered.
In Lubbock, TX, the community has launched a campaign called See Us Save Us to raise awareness on motorcycle safety. The campaign’s organizer, Deanna Jandrew stated that she launched the organization creating the campaign after a close friend was killed in a motorcycle accident. The organization conducted a motorcycle ride throughout Lubbock this past Saturday in an effort to educate the public on motorcycle safety and to pay more attention to the roadways in order to prevent any accidents.
Not only do riders have to deal with other drivers but also with poor road construction and hazards in the roads. The campaign organizer said one of the major causes of accidents between cars and motorcycles is that the drivers of the cars are not paying enough attention to the bikes.
One key point that the campaign organizer made was that a majority of accidents occur because of younger riders that get their first bike. Statistics have shown that a little over 300 accidents involving a motorcycle and a car involved riders that ranged in age between 16 to 20 years of age. In general, most accidents involving a motorcycle are a result of excessive speed or poor handling of motorcycles. The riders involved in this community ride were carrying 9 crosses as symbols for the 9 riders that lost their lives in the Lubbock area. That is the biggest tragedy in any accident, let alone motorcycle accidents. Fatalities in automobile accidents continue to rise because of various causes. This community ride could prove to be a good way to raise awareness for motorcycle riders so that they can maintain some sense of safety on the road.
A 56-year-old man was killed last year when his big rig fell off the side of the Bay Bridge in California. Now the man’s family has filed a wrongful death lawsuit against the California Department of Transportation and other companies arguing that they were negligent in the construction of the bridge and roadway. The incident occurred on November 9th when 56-year-old Tahir Sheikh Fakhar was driving his big rig transporting fruit and was unable to negotiate an S-curve on the bridge.
The truck then rolled over and fell 200 feet off the bridge. According to the report, the lawsuit claims there was insufficient signage posted to alert drivers of the S-curve in the road. In addition, the family is suing several other companies that were involved in the loading and transportation of the fruit in Fakhar’s truck arguing that the truck was overloaded beyond the legal limit of 80,000 pounds.
Many accidents occur as a result of unsafe road conditions or poor road design. In many cases, new developments in the roadway may be unexpected and drivers are unable to alter their speed and/or direction accordingly. In order to prove that a person or company is negligent in their actions, there are four things that need to be proven. The person or company must have some sort of duty to uphold, proof of failure to uphold that duty must exist, there must be proof of causation (meaning there must be reasonable proof that a person’s action or inaction caused the accident), and there must be proof of damages.
In this instance, the article states that signs regarding the new roadway construction were posted AFTER the fatal accident occurred. If they were not posted before, the Department of Transportation could be held liable for Fakhar’s death. The department of transportation has a duty toward the public to maintain its safety and that duty was breached when Fakhar’s vehicle fell over the bridge, causing Fakhar’s death. In any instance when the negligence of one party directly results in another party’s death, the deceased’s family deserves some form of justice.
Ocala.com reports that ten children were taken to three Florida hospitals after the school bus they were riding in was struck by another vehicle. A 2008 Mustang was exiting a subdivision attempting to turn onto a county road but failed to stop at a stop sign and collided with the left side of the school bus. The bus was reportedly traveling with 65 elementary school students at the time of the accident.
The ten children that were transported to medical facilities were taken as a precaution because they complained of neck and back pain following the accident. 25-year-old Christopher Harple, who was driving the Mustang, was charged with failure to stop at a stop sign and failure to show proof of insurance.
Public transportation is often thought to be a very safe way to travel and is very useful for those that try to save money as they don’t have to worry about gas prices in today’s economy. However, despite its advantages, public transportation can sometimes be very dangerous. Whether you are a passenger in a bus or driving a separate vehicle, auto accidents involving a bus can be very dangerous to the passengers in the bus and to the driver of the vehicle they crash into. This is especially true for children riding in a school bus. School buses don’t have seat belts so it is very easy for a child to fall out of their seat or worse. A school bus operator should always ensure that their passengers are safely in their seats and always try and maintain safety precautions on roadways.
A report from the Zanesville Times Recorder has posted a story on their website about a 33-year-old Zanesville woman that was hospitalized after suffering injuries in a motorcycle accident. According to the report, Misty Wood was attempting to take a curve in the road when her motorcycle swerved to the side of the road and she collided with a guardrail
Wood was ejected from the motorcycle and was lodged underneath a log as authorities arrived at the scene of the accident. Wood was reportedly wearing a helmet and safety glasses while operating the motorcycle. Her husband was following her in another motorcycle when the accident occurred. An investigation into the accident is currently underway and Wood has not been cited for anything in this accident. The report states Wood did not suffer any life-threatening injuries in the accident.
Since this incident was a one-vehicle accident and no other vehicle or person was involved, the only possible factors that could have contributed to the accident are excessive speed, road conditions or vehicle malfunction. There have been no citations handed to Wood following this accident but if Wood is found to be at fault for the accident, she could receive citations. The fact that her husband was following in a motorcycle behind her could work in her favor as he could provide information on whether she was at fault for the accident or not.
According to the Dallas Morning News, 18 people were injured when a charter bus carrying over 30 people collided with a concrete divider on a major interstate highway. The report states the bus veered out of control before colliding with the divider. The injuries that passengers suffered were bruises and broken bones. There were no deaths reported in the accident nor were any injuries life-threatening injuries.
The bus’s windshield shattered upon impact with the divider and three of the people that were injured were ejected through the passenger windows. The uninjured were taken to a church where they awaited another bus to drive them the rest of the way to their original destination. There is no information on the factors that contributed to the accident.
Public transportation is often thought to be a very safe way to travel and is very useful for those that try to save money as they don’t have to worry about gas prices in today’s economy. However, despite its advantages, public transportation can sometimes be very dangerous. Whether you are a passenger in a bus or driving a separate vehicle, auto accidents involving a bus can be very dangerous to the passengers in the bus. These types of accidents can lead to very serious injuries for all parties involved. In some cases, the driver in a bus could be easily distracted by a passenger in the bus and can inadvertently crash into a vehicle ahead of them. Driver fatigue can also be a major contributor to accidents involving a bus because bus drivers often drive for long hours in a day without getting a break. Although there is no way to ensure bus drivers maintain their vehicles properly and follow safety measures on the road, you can do so yourself. Always ensure you follow road signs and take extreme caution when on the road.
A report by the Orange County Register states that the company Yamaha is facing hundreds of lawsuits as a result of several roll-over accidents that have occurred involving the company’s Rhino vehicle. The off-road vehicle, which resembles a large golf cart, has caused extremely severe injuries according to the lawyers of the victims in each incident. Broken arms, legs and amputations occurred as riders of the Rhino were crushed underneath the weight of the vehicle.
One of the most recent lawsuits filed involves Daniel Swainston, who was crushed by the vehicle and suffered a broken leg as a result. According to Swainston, the vehicle tipped over when he was driving at a low speed through the Sequoia National Forest. The initial accident occurred in 2006 and the trial will occur in November of this year. The report states Yamaha faces roughly 700 lawsuits as a result of the accidents involving this vehicle.
According to the report, Yamaha is being accused of quickly settling cases where there is significant evidence that the company was at fault for the accidents named in the cases. However, in cases where evidence explicitly shows the driver was at fault, the company is quick to allow these cases to go to court as a way of creating a façade that the company is a responsible company and the drivers of their vehicles are not. The lawsuits that this company faces are very similar to those that Toyota faces currently with their vehicles. If the accusation that Yamaha selects cases they can easily win is true, it demonstrates the company’s lack of responsibility in ensuring or even caring for their customer’s safety. It demonstrates that they would rather be quick to blame the consumer rather than take responsibility if the accidents are caused by a malfunction or defect in their vehicles.
The New York Times reports that the automaker Toyota has reached an out-of-court settlement with the relatives of a family that was killed in an automobile accident involving one of their cars. According to the report, their Lexus sedan sped out of control due to a sudden acceleration problem. Toyota did not reveal the amount of the settlement but did confirm that a settlement was reached.
The accident named in the suit occurred one year ago when off-duty Highway Patrol officer Mark Saylor could not stop the vehicle from accelerating. The vehicle reached speeds of up to 120mph at one point. The vehicle later collided with another on the highway and landed in a ravine nearby. The 45-year-old police officer died as well as his wife, 45-year-old Cleofe Saylor, and their 13-year-old daughter. In addition, Cleofe Saylor’s brother died in the accident as well. The report reveals Toyota eventually recalled roughly 8 million vehicles total following this and several other incidents. According to the report, Toyota could potentially lose billions if they lose any other lawsuits that may be filed against them.
Although the lawsuits that Toyota has faced obviously demonstrate negligence on their part to properly repair or maintain certain vehicles, their compliance with any settlements and recalls shows their good faith in trying to remedy the situation. While settlements may alleviate the financial damage that these accidents cause, it will never alleviate the loss of loved ones that the victims in these incidents suffer. That is the biggest loss that these automobile accidents cause.
A woman was killed and five children were injured in a serious automobile accident. Police say the accident involved a Renault Clio vehicle carrying only the driver and a minivan carrying the driver and five children. The driver of Clio died and the driver of the van and all five children were seriously injured.
The driver of the Clio vehicle died as a result of her injuries. The driver of the minivan and three of the children inside only suffered minor injuries, the other two children suffered more serious injuries. None of the people that were injured had life-threatening injuries, according to the report. There is no information on the factors that contributed to the accident.
The Arizona State DPS reports that in fiscal year 2008, the Highway Patrol Division of the Arizona Police Department responded to well over 30,000 traffic collisions on major highways, 313 of which resulted in a fatality. Many traffic accidents along major highways occur as a result of drivers not following the speed limits. In the state of Arizona, the speed limit on major highways is 65-75 mph.
Statistics from the Arizona DPS show that approximately 8,669 traffic accidents along major highways result in some type of injury to one or more parties involved in the accident. In a high-speed accident on an Arizona roadway, there are many types of injuries that can occur to those involved. There are many possible causes of car accidents, including auto defects, DUI, and dangerous roadway conditions.
An Ohio man was seriously injured in a motorcycle accident that occurred Friday evening. According to the report on portclintonewsherald.com, 28-year-old Joshua Logan was transported to an Ohio medical facility after his motorcycle veered off the right side of the roadway he was driving on.
Logan reportedly missed the left turn in the road and drove into a ditch and was ejected from the bike. Witnesses to the accident found the motorcycle lying on top of Logan. He was reportedly not wearing a helmet when the accident occurred. There is no information on what specific injuries that Logan suffered in the accident.
Curved roadways can easily become a hazard for anyone driving, but this especially applies for motorcycle riders. Since motorcycles do not protect a rider from being ejected from them, the danger and risk of injury is higher than a normal vehicle. In addition, even small road hazards, such as potholes and oil slicks, can be extremely dangerous for motorcycle riders. Although this incident was a case of driver error, in many cases a motorcycle rider may lose control of their bike when they try and avoid hitting another car or obstruction on the road. In some instances, a driver in a regular car may cross in front of the motorcycle rider unexpectedly and cause the rider to collide with the car or swerve out of the way into the side of the roadway.
NBC affiliate KXAN News in Austin, Texas has reported that a teenage student has died in a serious automobile accident. According to the report, 17-year-old Jon Chin lost control of his vehicle and collided with a tree early last week.
Police stated that Chin sped down a roadway when he lost control and smashed into the tree. The vehicle was reportedly sliding sideways as it crashed into the tree. Chin was pronounced dead at the scene of the accident. He was reportedly not wearing a seatbelt at the time of the accident. There is no information on the factors that contributed to the crash besides excessive speed.
In the state of Arizona, statistics show that roughly 148 drivers ages 15 to 20 were killed in automobile accidents in 2008. That number is from a total 937 automobile accidents that occurred in 2008. Speeding fatalities amount to approximately 373 accidents in 2008. An accident can occur for anybody at any age. Teen drivers are just as susceptible as other drivers due to their lack of experience driving. However, when speed becomes a factor, a driver of any age can easily lose control of their vehicle and cause a serious accident.
A wrongful death lawsuit has been filed on behalf of a man who was killed when a street sweeper fell on top of him. Wlsam.com has reported that Brian P. Miller was killed in 2009 when he got stuck in the compressor of one of the street sweeping trucks belonging to the Hunter Maintenance & Leasing Corporation.
Miller’s sister, Keri Goff, has filed a wrongful death suit claiming that Elgin Sweeping Services, the company that owned the vehicle, did not repair the vehicle properly and directly caused her brother’s death. The designer of the street sweeper vehicles is also named in the lawsuit. Goff is suing for $600,000 in damages in a 12-count lawsuit, according to the report.
Construction and maintenance vehicles, like any other vehicle, can be very dangerous to work with. Aside from this incident, there have been many other instances where a person working with some kind of construction equipment has suffered very serious injuries or has been killed. If the company that owned the vehicle in this incident is found to be responsible in any way for Miller’s death, Goff will be awarded the amount named in the lawsuit. However, there must be direct evidence demonstrating that the company knowingly failed to maintain or repair the vehicle if necessary.
The family of a 17-year-old teenager is filing a wrongful death lawsuit after he was shot and killed. The report on wistv.com states that the man that shot 17-year-old Deshaun Clark will not be charged with the murder because the man’s attorney argues he shot Clark in self-defense.
However, rather than face murder charges, the man will face a wrongful death lawsuit from Clark’s family. According to the lawsuit, neither Clark nor his friends were carrying weapons of any kind in order to pose a threat to the man that killed him. Therefore, Clark’s family believes the claim of self-defense is untrue. The report states that there is no court date set for the wrongful death suit nor is there a dollar amount named for damages for Clark’s family.
In most cases, people will try to claim self-defense if they are found at fault for harming or killing somebody. However, in this incident, if Clark’s family is right and there is no evidence that Clark had any type of weapon, then the self-defense claim will be difficult to prove. Regardless, filing a wrongful death suit is warranted since there are no murder charges because Clark’s family deserves to have justice for the loss of their loved one.
A family in Dolton, Illinois has reportedly filed a wrongful death lawsuit claiming that Cook County, Ill. officers were responsible for their 16-year-old son’s death. According to the report, the parents of 16-year-old Kenyatta Brack Jr. are claiming that the officers were involved in a high-speed chase when the vehicle they were chasing struck their son’s bicycle and killed him.
Sherriff’s officers argue that the chase never exceeded speeds that would constitute high-speed. According to police, the driver of the vehicle being chased sped off in an attempt to flee from police officers after he sped by them. Officers attempted to flag the vehicle down when the driver began accelerating to get away from the police. Sherriff’s police argued they did not engage with the offending vehicle but instead called for back up. The parents of the 16-year-old victim are questioning police statements that they were not speeding, which is the reason for the wrongful-death lawsuit.
It is very easy for somebody to deny responsibility for any incident that occurs. According to the report of this incident, there is reportedly evidence that shows the police officers were not speeding at the time of the accident. If evidence does turn up showing that the officers were not speeding, it would be very difficult for the parents of the 16-year-old victim to win this wrongful death lawsuit. However, this should not stop anybody from trying to get justice and compensation should they find themselves in the same situation.
The Times Leader website has reported that the parents of a 20-year-old man that was killed when his vehicle collided with a tractor-trailer are filing a lawsuit against the driver of the tractor-trailer. Thomas Rogan and Denise Garofalo have filed a lawsuit against Richard Rody and the company that owns the tractor-trailer arguing that Rody acted in a negligent way and this directly caused the death of their son Joseph Rogan.
The accident that killed Rogan occurred two years ago on September 13th. The lawsuit alleges that Rogan had the right of way on the roadway he was driving on when Rody allegedly made an illegal U-turn. Rogan was unable to stop his vehicle and subsequently collided with the tractor-trailer’s side. The top of Rogan’s vehicle physically flew off and this led to Rogan’s death. Rogan’s parents are seeking damages that amount to well over $100,000 arguing that Rody ignored road signs prohibiting vehicles larger than 21,000 pounds from travelling on roadways. They also argue that Rody did not pay attention to the road nor did he abide by state driving laws.
There are many factors to be considered when a lawsuit of this nature is filed. In this case, the fact that the driver of the tractor-trailer made an illegal U-turn and did not abide by state laws regarding vehicle safety and driving laws, the lawsuit could be swayed in favor of Rogan’s parents. If he indeed had the right of way and the tractor-trailer drove into his direction causing the collision, Rogan’s allegations would be correct and they would win the lawsuit. However, if there is any evidence that points to Rogan being at fault, the lawsuit could go the other way. Regardless of who wins this lawsuit, it is nonetheless a tragedy that somebody that was only 20 years old lost his life as a result of a tragic accident.

The man was taken to the University Medical Center where he later died. A 17-year old teenager was also injured in this accident with injuries to his bicep and leg. Neighbors stated that the man and teenager were using a homemade device to set off the fireworks which may have contributed to the accident. Police are investigating the fireworks that were involved in the accident and the bomb squad is also involved. A preliminary investigation is currently taking place which indicates that this incident was an accident, although homicide detectives are also investigating.
With the beautiful bright colors and the excitement that comes with setting off of fireworks, it is difficult to associate fireworks as anything dangerous. With anything that has such risky components it is important to talk to your family and friends about simple safety practices when engaging in setting off fireworks. A lack of saftety practices, improper use of fireworks or even a disregard for the safety measures could have contributed to this devastating accident. It is also possible that the fireworks that caused the accident may have been defective or were improperly manufactured. In any scenario, contacting a professional can aid your family in finding out who should be held responsible for injuries or even death.
The attorneys that representing the children stated the helicopter company failed to fix a defect in the rotor of the helicopter blade that caused the crash. The $5.6 million is to be given in the form of trust funds for the children once they turn 18. The report states the children are 11 years old and 9 years old. The family of one of the other two crew members that were killed reportedly settled a claim with the helicopter company confidentially.
Although these children will be getting a very large sum of money from the lawsuit for the accident, it does not diminish the fact that they will never be able to see their mother. It can never compensate for the loss of a loved one in any situation. The companies whose products are involved in cases like this should always be held accountable for any defects or malfunctions that occur and cause severe injuries or fatalities as was the case in this incident.
According to statistics from the Bureau of Labor Statistics at the United States Department of Labor, the number of fatalities in construction labor jobs reached 975 in 2008. The statistics information states this is 19% lower than the previous total in 2007. However, the number is still very high. Construction workers face serious danger while performing their jobs. There have been numerous incidents of construction accidents in recent years both fatal and non-fatal. In the non-fatal incidents, construction workers have suffered very serious injuries as a result of the accidents. Construction accidents can occur as a result of malfunctioning equipment or improper use of construction equipment. Regardless of the cause of the accident, all construction companies should take all the necessary measures to ensure the safety of equipment and construction workers should ensure that they have a handle on using the equipment as some incidents can result from a construction worker not using a piece of equipment properly.
When highways are constructed or repaired there are hazards that, if motorists are unaware of, can be fatal. One such hazard is the roadway drop off.
A roadway drop off is where a newly paved portion of the road adjacent to the dirt portion of the road drops off without warning. This drop off, if deep enough, can cause the driver to lose control of his vehicle and not regain control before striking another vehicle or concrete road embankment.
Drop offs are more likely to occur on undivided rural highways with higher speed limits (between 45 and 70 mph) where drivers encounter twists and turns, driveways and oncoming traffic.
Good highway design and construction requires that the drop off on a highway where the speed limit is 55 mph should be no greater than one inch.
In addition, designers should provide space at the shoulders of highways to enable drivers to take evasive maneuvers to avoid potential crashes.
According to the American Association of State Highway and Transportation Officials, “well-designed and properly maintained shoulders are needed on rural highways with appreciable volume of traffic.”
