ATV Accident Kills Man and Injures Woman

In the desert terrain, ATV riding has become a popular sport for many families. Unfortunately many families are unaware that ATV riding produces more accidents than motorcycles, according to ATVsafety.gov. In Sumner County, KA a tragic ATV accident left one man dead and a woman critically injured on Saturday, October 17th at around 11pm.

The Wellington Fire Department had to use the “jaws of life” to remove the man and woman who were trapped inside a Polaris Razor. According to reports, authorities believe that the vehicle had hit a dirt hill and it caused it to roll several times. The woman was taken to Wesley Medical Center in Wichita and the man was taken to Sumner Regional Medical Center where he was pronounced dead. Police are still investigating whether or not alcohol was involved in the collision.

There are many ways to prevent ATV accidents, a few precautions listed on the ATV safety website include: wearing a helmet, getting trained, do not ride on tandem, do not allow children to operate adult ATVs, do not ride on pavement, and never ride under the influence.   Adults need to be very aware of the dangers of ATV riding in order to prevent accidents. In fatal crashes like this one, the problem can also be the actual ATV. Defective parts or faulty repairs have also been known causes in some accidents.

Baby Falls To His Death from SUV

In Rio Rancho, NM a family is grieving over an accident that killed their 10-month-old son, Nico Ortega. The mother, Nicole Ortega had just placed their son in the back seat of their SUV while his father went to get his car seat out of the garage. The mother apparently did not realize her son was leaning against the door and when her husband opened the door and Nico fell out.

The mother reached back and tried to grab Nico and her foot came off the brake and the door knocked the father out of the way and the baby fell out of the car. At that moment police have stated that is when the car may have ran over the baby. The boy died at the hospital on Thursday August 26th 2010. After the accident the police immediately took the family to the police department for questioning, where the Ortega family claims they kept them so long that they were unable to see their son before he passed away. Nico’s family have not currently charged, but police are still investigating the incident.

This type of accident could have been prevented by following simple safety rules. By putting the child in a vehicle and without a child safety seat it compromised the baby’s safety. This is a very tragic accident that has to be very difficult for any family to deal with. While there was some negligence on the parent’s part there could be many other factors that caused the accident like a possible vehicle malfunction. An Arizona personal injury attorney has the resources and skill to handle a case like this so your family receives the compensation they deserve.

5-Year-Old Girl is Nearly Strangled in Kindergarten Playground

A five-year-old girl is currently suffering swelling around her trachea due to almost chocking from playing with a rope and slide. Koreylee Raika was playing in the playground on Tuesday afternoon when the incident occurred

Her mother was called immediately and informed that Koreylee was being taken to Wellington Hospital. The incident has surfaced many questions from Koreylee’s mother, who wonders why there was a rope attached to the slide in the first place, and wonders why the playground was not better supervised. Wellington Kindergarten’s general manager is looking into the incident but assures that the people who were looking after the children were highly trained and capable. When Koreylee was untangled from the rope she collapsed, and a teacher immediately began performing CPR before the ambulance arrived. Some of the other children were taking part in some type of reverse abseiling activity involving the rope and the slide. The Kindergarten is now looking into the placement of the rope in order to prevent this type of incident from ever occurring again.

Playgrounds are usually home to the typical scrapes and bruises, but no parent ever imagines that a serious injury can occur from playing on a playground. When you entrust your child to a school system, you trust that they are going to be properly monitored and that no unforeseen dangers are in proximity to where they play. In a sensitive situation like this, it can be difficult to know who to blame and who to hold accountable for the physical injuries your child has endured. Contacting an Arizona personal injury attorney when your child has been injured is your family’s best option for compensation and for finding the responsible party.

Phoenix Man Hit By Car While Trying to Catch The Bus

On Thursday August 5th, 2010 a Phoenix man was struck by a white Chrysler 300 while running across the street to a bus stop. The 56-year old man was running across Hayden Road near Camelback Road when he was struck by the vehicle that was traveling southbound.

Police officials were called to the scene around 7:55pm. Police have stated that the man was not at the crosswalk when the incident occurred. The man was transported to a Scottsdale hospital where he died from his injuries. A police official has stated that any type of impairment was not a factor in this incident. Police are continuing to investigate the incident.

The families of both of these individuals involved are changed instantly because of one moment. This accident should have never occurred and could have been prevented by following some safety measures. It is important for instance to follow the safety measures like crossing at crosswalks and to also be aware of unexpected pedestrians not following the rules of the road when you are operating a vehicle. When you or a loved one is in an accident the hospital, funeral and psychological expenses can be excessive and overwhelming. An Arizona personal injury attorney can always help you and your family through this difficult time and help your family receive the compensation they deserve.

Girl Dies In Go-Kart Accident

In Grand Junction, Colorado a nine-year-old girl from Aurora has died in a tragic go-cart accident. Taybor Duncan’s go-cart collided with a maintenance vehicle at Grand Junction Motor Speedway. The police department stated that Taybor's go-cart rolled multiple times after it clipped a maintenance vehicle on Sunday morning.

Witnesses stated that Taybor had just crested a hill and was descending when her go-kart collided with a trailer and being hauled by a 4-wheeler that was trying to reach racers in another accident on the track. A speedway employee was operating the 4-wheeler. Taybor died instantly despite wearing a helmet, seat belt and protective chest plate. The Sheriff’s office is still investigating the accident.

Losing a child is the hardest thing for a parent to go through. In a tragic accident like Taybor Duncan’s it is difficult to know what course of action to take. Go-Kart racing is a popular activity for children and for adults but it is important to consider the risks and safety precautions of the sport. On the website www.gocartsguide.com, it lists a few safety rules to abide by in order to prevent this type of tragedy from occurring. A professional can help sort out the details of the accident and help establish who was negligent or if foul play was involved. The vehicle itself, the track, or even the helmet can all be looked at as contributing factors. An Arizona personal injury attorney is your family’s best option in a child accident because they understand how valuable a child’s life is and what it takes to bring the negligent parties to justice.

Bus with 22 Kids Crashes in Washington

In Bellevue, WA twenty two middle and high school students are in the hospital after their Boys and Girls Club bus crashes into a Blazer SUV on Friday evening. On the 15300 block of Lake Hills Blvd. at around 6pm the bus crashed into the Blazer SUV and careened across the road before slamming into a tree.

The bus had just left the Boys and Girls Club when the driver apparently suffered some type of medical event that contributed to the accident occurring. Some of the kids that were in the bus when the accident occurred have stated that they saw the bus driver slump over moments before the crash. The passengers were able to exit the bus and the medic treated the injured bus driver at the scene. All the passengers and the bus drivers were transported to Overlake Hospital Medical Center in Bellevue as a precaution, although luckily none of the kids appeared to have suffered any serious injuries. It is unknown what caused the bus driver to slump over. The Bellevue Police Department will be completing an accident investigation and the State Patrol will be inspecting the bus.

There are so many factors that could have contributed to the accident occurring, and if one of the children had suffered a serious injury then it can be difficult to know who to hold accountable. Your child should never be put in danger when driving any type of public transportation. Drivers have the responsibility to uphold a certain standard, and the company that employs the driver has the responsibility to ensure that the drivers are in the best shape and physical condition. If your child has suffered an injury from a bus accident, then contacting an Arizona personal injury lawyer is your best option for compensation for your child’s medical costs and suffering.

11-year-old Dies From Mechanical Gate

In Toledo, Ohio an 11-year-old girl became trapped in a mechanical gate in a housing community and died instantly. The mother Alesia Abbott was the first adult to rush to the scene as she saw her daughter Ahjzanae trapped yelling for help. Mrs. Abbott dialed 911 immediately but within minutes she went limp and died before authorities could arrive.

Ahjzanae was collecting rocks Sunday afternoon with her 4-year-old brother and another child in the enclosed parking lot in front of Museum Place Apartments. The gate was activated at 3:30pm trapping the girl. Authorities have stated that she became trapped between the mechanical gate and its control box. The victim died of compressive asphyxia because she was wedged into such a small space. Toledo firefighters pronounced her dead at 3:34pm on Sunday. The death is not being investigated as homicide; investigators have concluded that it was in fact accidental. It is still unclear how she managed to become trapped in such a severe way, but detectives have guessed that she was standing on the gate when the gate began to move. The death is the first accident with the gate or with the Wallick-Hendy’s properties. The gate manufacturers Linear Osco of Casnovia, Michigan declined to comment on the incident. Family members stated on Monday that they were devastated, and that Ahjzanae was irreplaceable in their family.

This tragic accident cost the life of a young girl because of an incident that could have been prevented. In a case like this, it is difficult to know who to blame and what course of action to take. This type of accident could have been prevented if a simple sign was placed on the gate or even if there was a warning sound every time the gate was going to be closed. It is little things like this that could have had an enormous impact. The gate manufacturer or even property owner could possibly be held responsible if either of these was supposed to occur and did not. If your child suffered an injury from a mechanical gate, contacting an Arizona personal injury lawyer is your best option for compensation.

60-year old Man Struck By Boat at Lake Pleasant, AZ

According to an article by abc15.com, on Friday June 30th a man was transported to the hospital after allegedly being hit by a boat in Lake Pleasant. Authorities have not yet released the man’s name, but he was in his late 60’s and was swimming in the lake as the boat was backing up.

According to reports the victim has a six to seven inch laceration on his abdomen and had to be air lifted to a valley hospital to treat his injuries. There is currently no word on his condition. Deputies are investigating the accident that happened at around 1pm at Scorpion Bay.

In 17% of all boating accidents, alcohol was the leading contributing factor. During the hot summer months thousands of families travel to Lake Pleasant for some fun and family time by the water. Families engage in all types of water activities, swimming, and fishing in Lake Pleasant and never think twice about the dangers that could occur. Boats have to abide by certain safety rules and regulations so these types of accidents never happen. One moment of carelessness can affect another person’s life forever. Some of the safety rules for operating a boat include: always wearing a life jacket, never consume alcohol before after or during driving a boat and always ensure that the coast is clear when backing up a boat are just a few prevention guidelines. If you or a loved one was involved in a boating accident and are unsure what course of action to take, then contacting an Arizona personal injury attorney is your best option for compensation.

New ATV Safety Legislation Passes in Boston

New legislation has been put into effect in Boston, MA that will put serious regulations on ATV riding, much to the relief of families who have been victims of having their children injured on or by one. The legislation has received some criticism from avid ATV riders.

The new legislation is called Sean’s Bill in honor of an 8-year-old who was killed in 2006 in an ATV accident. The legislation aims to prevent young kids from riding machines that are too powerful for them. It has changed the legal riding age to 14 years old opposed to 10 years old, with the exception in sanctioned races. The legislation also set a limit to the engine size for 14 to 16 year olds to 90 cubic centimeters. Riders who are between 14 to 16 year olds also have to be supervised by someone over the age of 18. The law also requires that all riders under the age of 18 must take vehicle safety and responsibility courses. One statistic by the Consumer product safety commission states 74 children under the age of 16 were killed on ATV’s in 2008.

ATV’s are so popular among today’s youth that it is no wonder why there is legislation trying to ensure that is trying to keep them protected. Unfortunately not all states have this type of legislation in effect, so your child can still be in danger. A manufacturing defect or another reckless driver is just two potential causes of an ATV accident. If you or a loved one has suffered an injury by an ATV contacting an Arizona personal injury can help you prosecute the responsible parties involved.

Slack Group Sued After Electrical Injury

Wvrecord.com reports that a Sissonville, VA woman is suing a company called Slack Group after suffering an electrical shock injury. According to the report, Cathy Seabolt was walking through a trailer park to visit one of the homes when she suffered a shock from a live electrical wire.

Seabolt is claiming that the company should be held negligent for failing to shut down the electricity from the live wire. Seabolt claims the company should be aware of any dangers in the trailer park and keep residents and visitors from suffering any kind of harm while on the premises. Seabolt is claiming she suffered several severe injuries including to her face, head, back and feet among other areas of her body. She is seeking compensation for her injuries but no amount has been reported as of yet.

A company should always be held liable for any injuries that occur to customers resulting from a defect or anything else that can cause harm. In this case, the company could have known that the live wire was still on the premises and could easily have disposed of it, preventing any injury to visitors and residents of the trailer park. The fact that they did not remove the live wire from the premises could potentially constitute negligence on the part of Slack Group.

Fort Wayne, Indiana Man Killed In Motorcycle Accident

The website Indiananewscenter.com is reporting that a previously unidentified motorcycle crash victim has now been identified. 46-year-old Walter W. Wurmel Jr. was killed in a motorcycle accident that occurred Saturday morning. According to the report, Wurmel was riding a 2000 Harley Davidson motorcycle and he suffered blunt force injuries in the accident which were a direct cause of death.

Tests to determine if alcohol or other substances were a factor have not been completed as yet. The accident was reported to 911 just after 3:00 AM. The caller that reported the incident stated that they saw a man lying on the ground and that he appeared unconscious. Wurmel was reported dead at the scene of the accident. The accident was reported as a single-vehicle accident at the time the report was posted. There were no witnesses to the accident and an investigation is still underway.

There are many reasons for a motorcycle rider to be the victim of a single-vehicle accident. Since a full investigation is still underway, there is no way to know what the cause of the accident was and many possibilities still exist. Anything from alcohol to improper motorcycle training could have been a factor in this accident.

14-Year-Old Boy Crashes During Police Chase

The News Herald website reports that a 14-year-old boy led police officers on a high speed chase on June 12th that ended with the boy crashing. According to the report, a police officer saw a Ford Taurus driving with its lights off. The officer proceeded to follow the vehicle in an attempt to pull the driver over. The driver attempted to get away from the officer, increasing speed and swerving into oncoming traffic lanes.

At one point during the chase, the vehicle was driving at 90 miles per hour in a 35 mile per hour zone. The teenage driver reportedly kept attempting to hit other vehicles on the road way including a vehicle driven by a 54-year-old woman. The woman was able to swerve out of the way and avoid a collision. The chase ended when the teen drove over a curb, into the sidewalk and grass and crashed into an unoccupied vehicle in the parking lot of an apartment building. The teen faces several charges in juvenile court and the boy’s mother was cited for parental responsibility.

This incident demonstrates a blatant case of negligence and irresponsibility on the part of the boy’s parents. A child should never be in a position to put themselves or others in danger, especially on roadways. An underage child operating a vehicle puts the child in danger because they don’t know how to operate a vehicle and this also puts others in danger. The fact that the boy in this incident was clearly attempting to hit other vehicles on roadways only increases the danger that this child faced.

Oklahoma Motorcycle Accident Kills 12-Year-Old

The News 7 website in Oklahoma has reported that a 12-year-old boy was killed in a motorcycle accident while he was riding on private property. 12-year-old Randy Catron was killed on Monday after he failed to yield to oncoming traffic before entering the county roadways. 20-year-old Jennifer Pack was driving her vehicle when she hit the motorcycle.

The 12-year-old boy died at the scene of the accident. Pack was not injured in the accident and neither was the passenger in the vehicle she was driving.

This incident raises many questions including why the 12-year-old boy was riding a motorcycle alone. Kentucky state law states that all riders 16-years-old and under can only operate a 90cc or less powerful motorcycle. Under the age of 12 requires direct supervision by parents or guardian and riders can only ride 70cc or less powerful motorcycle. In addition, the bikes that are legal for children 12 and up are only supposed to be off-road vehicles. As this case demonstrates, motorcycle accidents can always occur that are extremely serious. Some cases may result in less serious injuries but in most cases, the rider of the motorcycle (whether it is an off-road bike or not) could easily end up with very serious injuries or fatality.

Baby Drowns Due To Faulty Automatic Drain Stopper

A six month old baby who was described as a “very cute happy little baby” was taken to the hospital from almost drowning in a bathtub on Thursday May 5, 2010.  According to police reports, the mother left the infant unattended to check her e-mail for five minutes while the water was running.

Although the drain was left open, the automatic drain stopper apparently activated and the tub filled with water.  After the mother found the baby under water, the mother grabbed the child, ran outside crying and yelled, “My baby drowned” until two workers came to her and one of them performed CPR on the baby. When the firefighters showed up at the apartment complex, the baby was still not breathing.  The baby was then transported to Phoenix Children’s hospital where he was pronounced dead.  Police officials have not stated whether or not the mother will face criminal charges.

Accidents like this one happen more often than they should.  It takes a minute of carelessness to have your life changed forever.  The family of this child cannot undo this accident, but hopefully parents will learn from this incident so the same tragic occurrence won’t happen to their family.  This tragedy should be a wakeup call for parents who think that this type of accident could never happen to them.  A child’s life should not be left to a piece of equipment.  There are several ways that an accident like this could have been prevented.  It is important that parents never leave their baby unattended so they are not left to face this emotional heartbreak.

Offers of Quick Settlements for Accident Claims

I'm frequently asked about whether accepting a "quick" settlement for a minor accident claim isn't better than waiting several weeks or months after the accident.

The problem with a "quick" settlement is that an injured person only gets "one bite at the apple", and if the injury turns out to be worse than first thought....you are out of luck!

To be safe you should wait at least four months after you are symptom free to consider settling your accident claim, even for a minor accident.

Prompt Medical Care After an Accident

Many times immediately after an accident, even though a person is injured, the adrenalin rush minimizes any pain. Because of this condition, individuals requiring emergency care may postpone obtaining treatment.

Within a day or two after the accident, pain otherwise absent begins to appear.

This delay in diagnosis and treatment can result in increased injury, prolonged care and rehabilitation.

In addition, it may appear to the untrained observer that an injury should be present immediately after an accident and therefore any delayed appearance means that the injury has been manufactured.

The lesson to be learned is that anyone involved in an accident should be seen at a hospital emergency room or by a family physician as soon as possible.

Remember, early evaluation and treatment can avoid costly and painful consequences.
