Maryland Boating Accident Leaves Six Injured

In Ocean City, MD six people were injured in a boating accident. The boat involved in the accident was a sixteen foot open cockpit boat which was holding seven people when the accident occurred. The boat struck an intercoastal waterway marker injuring six of the people on board, one of them being an eight-year-old child.

Jode Dritzel, 38, was operating the boat when the accident occurred. State police are stating that the accident was a result of an operator error. Eight year old Jared Dritzel was airlifted to Cooper County Trauma Center from the Ocean Center Airport. The flight crew reported that Jared Dritzel is reported to be in stable condition. According to police, Jared was thrown from the boat when it struck the channel marker. The other four people who were involved in the accident were Atlanticare Regional Medical Center in Atlantic City. While no charges have been filed, the accident is still under investigation by the State Police Marine Unit.

With every body of the water there are risks for all different kinds of water sport accidents. Boats in particular can have faulty mechanical components and could have encountered a serious engine issue. In some cases the driver had been suffering a serious illness that impaired their driving or was even injured while driving. Boating accidents can have many complicated and intricate reasons for occurring. Contacting a professional who understands the dynamics of these types of accidents is always the best option when in these situations.

Officer in Grave Condition Following Automobile Accident

31-year-old New York police officer Carlos Olmeda is in grave condition in Brooklyn, NY following emergency surgery. Officer Olmeda was chasing robbery suspects on foot when a motorcycle struck him and sent him flying in the air. Officer Olmeda landed head first on the pavement and suffered severe head injuries as well as a broken arm and leg. Emergency surgery was performed in order to relieve pressure on officer Olmeda’s brain resulting from the accident.

People are well aware of the dangers of driving and the many causes of accidents on roadways. However, many people do not take into consideration the possibility of accidents involving a pedestrian on the side of roadways. People walking along sidewalks or parking lots or in driveways are in greater danger of being hit by a driver either not paying attention to the road or a driver who is impaired in some way. For example, drunk driving can greatly increase the possibility of a pedestrian being hit by a car.

This case demonstrates that accidents can even occur when someone crosses the street. The injuries that officer Olmeda suffered in this accident are just the tip of the iceberg in terms of the severe injuries that can occur to either a pedestrian, or in this case, a police officer crossing the street in pursuit of a suspect in a crime. In many cases, injuries can be severe enough to cause a fatality.

Motorcycle Accident Leaves Florida Man Critically Injured

WMBB in Florida reports that a Grand Ridge, Florida man is critically injured after being thrown from his motorcycle when another car struck him from behind. 18-year-old Steven M. Hooppell was struck by 59-year-old Angela D. Jackson’s car causing the motorcycle to flip. Jackson was unharmed in the accident and Hooppell remains in critical condition. The report states that charges are currently pending in the accident.

According to the National Highway Traffic Safety Administration, roughly 71 fatalities occurred for motorcycle riders riding without a helmet in 2007 and 64 riding without a helmet in 2008 and total fatalities ranged in age between 20 to 29 years of age. Motorcycle safety on the roadways is extremely important because of the increased chance for severe injury. It is clear that motorcycles do not offer sufficient protection for riders. In most cases, motorcycle riders do not wear a helmet, which exponentially increases the chances of serious injury or even death. Wearing a helmet can easily protect the rider from serious damage to the head and neck, which can drastically improve their chances of walking away from the accident.

Although it is impossible to account for every situation involving a motorcycle and a car, you should always take extreme caution to avoid any type of accident due to the increased risk for injury. Actions such as cutting off a motorcycle while turning can put a rider in extreme danger of falling off the motorcycle or even being propelled over the bars of their motorcycle.

Complaints Spur Investigations of Windstar and Corvette

The National Highway Traffic Safety Administration has begun two separate investigations on the Ford Windstar and Chevrolet Corvette following complaints of malfunctions. USNews.com reports that the NHSTA has received 234 complaints on malfunctions of the rear axles of 1999-2003 Ford Windstar models.

The investigation on the Corvette resulted from 30 complaints from consumers of leaking fuel tanks. The report states that no injuries or accidents in the Corvette have been reported at this time; however, two minor incidents have been reported with the Ford Windstar. A recall of both vehicles could potentially occur if the NHSTA deems it necessary.

It is no secret that the automotive industry has been plagued by recalls of all kinds. The most recent, and most significant, is the Toyota recall of several thousand cars of differing models for various reasons. As a result of Toyota’s delay in their recall, they were forced to pay fines of around $16.4 million. Since that time, automakers have been voluntarily recalling vehicles for various flaws and malfunctions in a timely manner seemingly in order to avoid a similar fate.

It is very important that automakers follow all government enforced rules regarding recalls in order to prevent injury to consumers. Although incidents of accidents or injuries are minimal in the case of the Windstar, there could potentially be more serious incidents if no action is taken to remedy the situation in their vehicles. Although many accidents on roadways occur due to driver error, there are still cases when an auto accident can be caused by a malfunction in the vehicles involved.

If you are involved in an accident, a manufacturer malfunction may be one of the causes, but the malfunction may not be readily apparent.  For more information on manufacturer malfunctions and how to identify them, visit the Solomon & Relihan Auto Defects page.

Florida Highway Patrol Accident Killed in Auto Accident

The Miami News Times website has posted a report of the death of Florida Highway Patrol Officer Patrick Ambroise. According to the report, officer Ambroise was parked on the side of the road when the car was struck by another car driven by 19-year-old Jonathan Garcia. The collision then sparked a fire inside the officer’s car and he later died at the scene of the accident. Garcia, the driver of the other car, remains in the hospital following the accident. The report does not state what caused the fire in Ambroise’s patrol car.

Rear impact collisions are very similar to frontal impact collisions in that it does not take a high rate of speed to cause varying degrees of injuries to victims. In most cases, rear impact collisions are not as serious as frontal or side impact collisions since both vehicles involved are traveling in the same direction and not in opposite directions – if the two vehicles were traveling in opposite directions, the impact would be far greater than if they were traveling in the same direction. Regardless, it is still possible to suffer serious injuries resulting from rear impact collisions. A majority of injuries occur as a result of the force pushing the victim forward, causing varying degrees of injury to the head, neck or back. As this case demonstrates, even fatality can occur from rear-impact collisions, especially if the driver of the other vehicle is moving at a high rate of speed.

BMW Forced to Recall Motorcycles After Malfunction

AFP News is reporting that German automaker BMW announced a global recall of 122,000 motorcycles as a result of malfunctions with the front brakes. The K 1200 GT motorcycles were discovered to have leaks in the braking system in models built between August 2006 and May 2009.

The rear brakes of the motorcycles are not believed to be affected by the malfunction. The leaks in the front brake system are thought to be caused by vibrations created by the motorcycle itself (engine vibration, etc). There have not been any accidents or injuries reported due to the malfunction in the motorcycle.

This case presents two potentially serious dangers for motorcycle riders. The malfunction of the braking system in any vehicle could possibly cause very serious accidents resulting in equally serious injuries for the driver. However, in this case this danger is compounded by the fact that the affected vehicle is a motorcycle. It is a well-known fact that motorcycles do not always offer sufficient protection for riders. It relies on the rider’s ability to operate the motorcycle at his or her own discretion and risk. Although there have not been any accidents reported, the malfunction of the braking system in these motorcycles could cause very serious accidents including causing the rider to be thrown from the bike. In cases involving a motorcycle accident, the injuries that could potentially occur for the rider could cause a fatality or leave the rider in grave conditions.

Manufacturer errors and malfunctions are a frequent, and often frequently-overlooked, cause of car and motorcycle accidents.  For more information on this, please visit Solomon & Relihan's Auto Defects information page.

Accident Injury Settlements in Arizona

Soon after you recover from the shock of an accident, the first thing you should think about is, “how do I go about settling with the insurance company without being taken advantage of.”

You should consider settlement as two separate transactions. One for your property damage and the second for your injury.

Settling property damage claims is relatively straight forward. Your vehicle needs to be repaired or replaced and the cost of each can be determined by simply contacting repair shops and car lots to obtain estimates for repair or replacement costs for vehicles that are totaled.

Some property damage issues are in fact more complicated, such as the value of custom vehicles or the diminished value of damaged vehicle upon sale. These issues require special knowledge and negotiation.

The area requiring the attention of an attorney with investigation and negotiation expertise is that of a bodily injury claims attorney.

The value of these claims are mainly subjective necessitating knowledge of the insurance company tactics as well as local values of similar injuries.

For example, the value of an injury claim in Arizona is different than the value of an injury claim in California. The value of these claims are based, in part, on the amount juries award for similar injuries in local courts.

The likelihood of receiving the maximum value for an injury claim is substantially enhanced by a speedy investigation and an experienced negotiator.
