New Jersey Woman Charged with DUI Following Car Wreck

A 25-year-old New Jersey woman involved in a three-car accident was arrested and charged with driving under the influence. Police said the accident involved a Parking Authority official and the accident resulted in the street being shut down to clear the debris. The accident occurred as the Parking Authority vehicle was attempting to make a left turn from a southbound lane when the woman driving the other vehicle struck the official’s vehicle. Her vehicle continued to veer onto the sidewalk following the accident before coming to a stop.

The third vehicle involved tried to avoid hitting the official’s vehicle and veered to the right but wound up hitting the woman’s vehicle instead. The woman was also charged with possession of drug paraphernalia, and possession of a controlled substance.

Almost any decision we make could wind up becoming a dangerous one when we’re on the roadways because we can never be prepared for anything on the road. However, there are other decisions we make that are blatantly obvious bad decisions and getting behind the wheel while under the influence of any sort of substance is one of those decisions. Nobody should ever consciously choose to get behind the wheel after consuming alcohol or some other substance that could negatively affect them in some way.

Another dangerous aspect is one that the driver could not have controlled but still could have hurt many more people. The fact that the vehicle rolled into the sidewalk following the initial collision could have injured anybody walking along the sidewalk at the time of the accident. If other people had been injured, the potential punishment that the 25-year-old driver could face could become significantly higher.

In the state of New Jersey, there are different punishments both for drug possession penalties and possession of drug paraphernalia. Possession of drug paraphernalia carries a possible sentence of up to six months in jail and fines up to $1000. Possession of a controlled substance carries a possible penalty of up to 5 years in jail and fines that could go up to $25,000. The perpetrator would also be required to fulfill a drug rehab program as well.

Getting behind the wheel when under the influence of a substance or when in possession of substances that are against the law should always be punished to the highest possible extent because of the severe danger it places on both the driver themselves and anybody around the roadway at the time if there is an accident.
 

Woman Files Suit after Son's Death in Auto Wreck

The mother of a 20-year-old man that was killed in an automobile accident involving a 22-year-old man has filed a lawsuit against the 22-year-old. The victim’s mother claims the 22-year-old driver was driving under the influence of alcohol that directly caused the victim’s death. The accident occurred when the defendant in the suit collided with the victim’s van. The victim died later of the injuries that he suffered.

The lawsuit also names the restaurant where the 22-year-old driver had been drinking, arguing that the employees continued to serve him alcohol even when he was visibly intoxicated. The restaurant’s owner stated they have a strict policy to not serve alcohol to patrons who appear intoxicated. Police said the defendant showed signs of intoxication right after the crash had occurred and he had a blood alcohol level of .22.

In some cases when a person is killed in an accident of some kind, there is not always a clear distinction as to who is to blame for the accident no matter how much the victim’s family may want to blame the accident on somebody. However, in this case it is clear that the 22-year-old driver should be held accountable for his actions because he made a conscious decision, despite poor judgment, to get behind the wheel of his vehicle knowing he was intoxicated.

People always feel they can handle drinking a certain amount before they are too intoxicated to drive. However, any amount of alcohol that raises the blood alcohol level above .08 is considered over the legal limit and you could face significant penalties, especially if you are involved in an automobile accident. In this case, although the restaurant claimed they have a policy that prevents them from serving alcohol to patrons that are clearly intoxicated, if witnesses saw the employees continue to serve alcohol to the defendant, or if they saw the defendant get alcohol from his friends, the restaurant could be held accountable for not following their policy and allowing the defendant to continue to drink.

Getting behind the wheel while intoxicated can pose a serious danger not only to the driver but as this incident demonstrates, it can also pose a danger to those around them. Incidents like this one could easily be avoided and the victim’s family deserves to have some sort of justice on their behalf for the loss of their loved ones.

 

Motorcycle Wreck Leads to Severe Trauma for Victim

A 44-year-old man was transported to a medical facility in South Lyon, MI in critical condition after he lost control of his motorcycle and collided with a guardrail in the oncoming lanes of a road. The 44-year-old man was unable to make a turn at a curve in the roadway when he lost control of the bike. The victim was subsequently ejected from the motorcycle and suffered severe trauma from the accident

Both alcohol and high speed are believed to be factors in this crash. An investigation is ongoing into the specifics of this crash. Police noted that the man was wearing a helmet at the time of the crash.

People are always warned of the possibility of getting into a serious accident when we operate a vehicle under the influence of alcohol. Still, many people decide to either challenge this notion or completely disregard it and get behind the wheel of a vehicle, or in this case operate a motorcycle. When a person operates a motorcycle, there is already a significant amount of danger involved in it because there is very limited protection for that driver. Unlike a car, a motorcycle is not encased and closed off and it is very easy for a rider to be thrown from the bike when they hit a bump or some other obstruction in the road.

Even in a standard vehicle, there is still the chance of being ejected from the vehicle if the driver is operating the vehicle at a very high rate of speed and not wearing a seatbelt at the time of an accident. Authorities always stress the fact that wearing a helmet when driving a motorcycle could easily be the difference between a fatality and injuries that a person can recover from. Although the driver in this incident suffered serious trauma as a result of the accident, there is still a chance that he will pull through from his injuries and walk away. Unfortunately, there are many people who lose their lives in these types of accidents. In addition, there are equally as many people in surrounding vehicles and walking in the surrounding area that could be affected negatively by a person’s choice to operate their vehicle or motorcycle while under the influence of alcohol.
 

Woman Suffers Broken Neck in Car Wreck, Driver Gets DUI

A 22-year-old driver was charged with negligent vehicular assault, criminal endangerment, and a misdemeanor count of DUI following an automobile accident that left a 20-year-old female passenger with a broken neck. Mitchell Lane Ralph was reportedly riding with 4 other passengers in his pickup truck when he lost control of the vehicle and rolled through an embankment.

 The 20-year-old passenger was ejected from the truck and a second female passenger also suffered serious injuries in the crash. Two male passengers riding with Ralph suffered less severe injuries. Ralph reportedly admitted to the judge that he was intoxicated and distracted when the car went off the road. Ralph is currently free on a $40,000 bond.

Two very dangerous factors played a part in this accident; operating a vehicle while intoxicated and being distracted on the road. These are two very common reasons why people are involved in very serious automobile accidents. The report states that Ralph had been cited for a misdemeanor charge of DUI in the past prior to this accident. Two other charges were dismissed in this incident including driving without insurance and having an open container in a vehicle.

In the state of Montana where this accident occurred, a driver charged with DUI could face up to 6 months in jail and up to $1,000 in fines for a first offense. This accident could easily have been avoided if the driver of the pickup had not been drinking. Now as a result of his actions, a 20-year-old woman suffered a broken neck and one other person was in the hospital with serious injuries.
 

19-Year-Old Faces Vehicular Assault Charges in Car Accident

A teenager is facing serious charges of vehicular assault, careless driving, and driving under the influence of alcohol, vehicle theft, and causing a hit-and-run accident. 19-year-old Nicholas Joseph Binder was involved in a roll-over accident at the intersection of Seventh St. and Crossroads Blvd. in Colorado.

Police stated they saw one person running away from the scene on foot and one person lying on the ground at the scene of the accident. The passenger of the vehicle was ejected from the vehicle when it hit the curb and went airborne.

The car flew 50 feet in the air before it hit the ground and began rolling end-over-end. The passenger in the vehicle suffered several spinal fractures, a fractured pelvis, and several other injuries. The vehicle was found to be stolen and the owner of the vehicle pressed charges against Binder. There is no information on what penalties Binder could face as a result of this incident.

This is one of many incidents that demonstrates how alcohol can severely alter a person’s judgment and cause a very serious accident. The 19-year-old was clearly intoxicated when police caught him as he was reportedly slurring his words and staggering on his feet. The worst part of this incident is that the driver was 19 and yet he was still intoxicated. Drinking under age could result in more serious charges against him adding to the penalties he already faces as a result of this accident.
 

Drunk Driver Kills Passenger

In Washington State, a 24-year-old man pleaded guilty to drunken driving causing the death of a 19-year-old and injuring a 17-year-old and a 25-year-old passenger in his vehicle. Loren Seaman had a blood-alcohol level of .20 at the time of the accident. The legal limit in the United States is .08. Seaman was driving along a mile-long stretch of road when he collided with a telephone pole backwards.

The rear of the vehicle smashed into the driver’s seat and killed the 19-year-old passenger instantly. The 17-year-old passenger suffered a broken leg and fractured back while the 25-year-old passenger suffered a concussion and a displaced hip. Seaman suffered broken ribs and internal injuries in the crash. Seaman was sentenced to 55 months in prison on charges of vehicular assault, third-degree assault and vehicular homicide.

This incident demonstrates how drunk driving can affect people both inside and outside the vehicle, including the driver. The blood-alcohol level that Seaman had was close to 3 times the legal limit in the United States. It doesn’t take very many drinks to have a blood alcohol level over the legal limit; however, most people don’t take this into account and attempt to get behind the wheel. As a result of Seaman’s actions, a mother has to live her life without her child and 2 others were seriously injured as well. Nobody should have to lose their lives as a result of one person’s senseless actions. Anybody that chooses to get behind the wheel after having a few drinks should be brought to justice if they are at fault for causing a serious automobile accident.
 

Drunk Driver Severely Injures His Two Passengers

Two men in Illinois were seriously injured after an automobile accident occurred as a result of the driver operating the vehicle under the influence of alcohol. 22-year-old Eric J. Larson suffered non life-threatening injuries. The 23-year-old passenger suffered a broken back, a punctured lung, and a broken ankle. A second passenger suffered an eye injury and a possible broken leg.

Larson faces charges of operating an uninsured vehicle, failure to reduce speed to avoid a collision, and driving under the influence. Larson’s blood-alcohol level was reportedly above the legal limit but the Triblocal report does not specifically state what his blood-alcohol level was.

People are not always aware exactly how blood-alcohol levels can affect their level of impairment while operating a vehicle. Even a blood alcohol level below the legal limit could cause a person to be impaired while operating a vehicle. This is especially true if their tolerance to alcoholic drinks is very low. It does not take much alcohol for a person to be impaired enough to be unable to operate a vehicle normally. Consuming alcoholic drinks can cause dizziness, reduced reaction times and impairment of judgment.

Each of these factors alone and combined can cause extremely serious automobile accidents resulting in equally serious injuries for the victims. The worse part of this incident is the victims’ young ages. They are just entering their 20’s; they are still at a very young age and should never have gotten into a position to suffer as much as they have. If the passenger in this incident had lost his life, the driver could have been held accountable for his actions and sentenced to long periods in prison at such a young age.
 

18-Year-Old Man Charged With Vehicular Homicide

An 18-year-old New Jersey man pleaded guilty to several charges including assault by auto and vehicular homicide stemming from an incident that occurred in March. Michael Woehrle, then 17 years old, was originally charged as a juvenile but had his case transferred to criminal court in the Superior Court in Freehold, New Jersey. Woehrle pleaded guilty to the charges in connection to the homicide of 22-year-old Tyshon Thorpe.

In addition, Woehrle was charged with at DWI and violating the graduated driver’s license rules in the state of New Jersey. The initial incident occurred on March 21st when Woehrle was driving a Hyundai Elantra and collided with a BMW 328. Thorpe was the passenger in the Elantra. Thorpe died at the hospital just one hour after the accident initially occurred. Woehrle suffered a serious head injury in the accident and is currently in custody in a county jail waiting for sentencing.

DUI and DWI laws vary from one state to the next. In the state of Arizona, the DUI laws depending on a person’s blood alcohol level are as follows:

DUI w/blood alcohol level 0.08 or higher
This charge carries a minimum of 10 days in jail with a possibility of a license suspension of 9 days following the completion of alcohol education. A $250 fine plus supplement charge (totaling $600 or more) will be charged. A maximum sentence carries a 6-month jail term with a $2500 fine including supplemental charge, a penalty of 3 years probation will also occur.

DUI w/blood alcohol level of 0.15 or higher
Minimum of 30 days in prison with possibility of 20 days suspended following completion of alcohol education. A fine of $250 will also be charged including other additional fees totaling $750. A maximum sentence carries a 6-month jail term plus $2500+ fee and 3 years probation.

In this incident in the state of New Jersey, Woehrle could possibly receive a sentence of five years in prison and ineligibility for parole for four years. This sentence will be handed down if the Superior Court judge accepts the prosecutor’s recommendation for this sentence. If this type of accident results in a fatality, the person responsible should be held responsible for their actions and brought to justice.

Driving while intoxicated with any substances; not just alcohol, can dramatically reduce a person’s reaction time and cause extremely serious injuries to victims in the streets, sidewalks or in other vehicles. This incident demonstrates the severity of driving while intoxicated as the sentence that Woehrle is facing amounts to five years in prison, which is one of the minimum sentences under the law. Everybody is well aware of the dangers of driving while intoxicated with any substances. Nobody should put themselves or others in a position to be seriously injured or killed simply because of a lack of good judgment trying to operate a vehicle while intoxicated.
 

A New Year's Resolution for Safer Streets

As a new year begins, people across the country are making resolutions to do a few things differently. Hopefully for at least 4,500 Arizonans, one resolution will be to stop driving while impaired.

Four thousand five hundred is the number of Arizona residents who were arrested for DUI since Thanksgiving. That's almost a 2000 person increase since the holiday season of 2008. The Associated Press reported, arrests for the entire year numbered above 14,000: a 3,500 increase since 2008.

These rising numbers reveal two trends. The first is the good news that increased enforcement has taken more unsafe drivers off the road. Hopefully this will inspire them and others to stay sober behind the wheel.

But, the second trend is of a large number of drivers ignoring the potential consequences of impaired driving and choosing to put others at risk. Preventable injuries to motorists and motorcyclists are caused each week when someone makes the negligent decision to reach for the keys when buzzed or drunk.

We can only hope that public awareness and deterrence can begin to lower number of impaired drivers and the injuries they cause. Perhaps this holiday's spike in enforcement will help spread the message and keep Arizona's drivers a little safer in 2010.
